Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Supercal service. By creating an account and using our service, you agree to comply with these Terms and our Privacy Policy. If you do not agree, please do not use our service.

1. Acceptance of Terms

By registering for an account, you affirm that you have read, understood, and agree to these Terms. We may update these Terms periodically, and we will notify you of any significant changes.

2. User accounts

To access Supercal, you must create an account. During registration, you will provide the following information:

  • Email address
  • Name
  • Profile picture
  • Calendar events

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Responsibilities

You are responsible for all content you share through Supercal, including but not limited to:

  • Profile pictures
  • Name
  • Profile bio
  • Calendar events

Sharing illegal content

You agree not to engage in any activities that violate applicable laws or regulations, including but not limited to:

  • Sharing illegal content
  • Harassment or intimidation of others
  • Disseminating pornographic or pedopornographic material

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Payment Terms and Refund Policy

Currently, Supercal is offered free of charge. We may introduce paid plans in the future, and any changes to pricing or payment terms will be communicated to users in advance.

If a paid service is implemented and you have not utilized the service, you may request a refund. Refunds will be processed at our discretion.

5. Data Privacy and Security

We are committed to protecting your personal information. We collect the following user data:

  • Profile picture
  • Name
  • Calendar events

Your calendar events will be automatically deleted if they are no longer available or if your calendar is deactivated. We do not share your personal data with third parties under any circumstances.

6. Integration with Other Apps

Supercal integrates with various calendar providers, including Outlook, iCloud, Google, and others. By connecting your calendar, you allow Supercal to sync your calendar events.

Supercal is hosted on Supabase, which is hosted on AWS in Europe (Paris). You control the visibility of your calendar events, with the default setting being &ltquo;restricted”, meaning others will only see that you are &ltquo;busy”.

7. User Content Ownership

You retain full ownership of all data you upload or share via Supercal. Supercal does not claim any rights to your content. However, by using the service, you grant Supercal a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content for the purpose of providing and improving the service.

8. Indemnification

You agree to indemnify, defend, and hold harmless Supercal and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising from your use of the service, your violation of these Terms, or any infringement of third-party rights.

9. Limitation of Liability

Supercal strives to provide a reliable service; however, we do not guarantee its availability or reliability. In no event shall Supercal be liable for any indirect, incidental, or consequential damages arising from your use of the service, including loss of data or profits.

10. Termination of Service

Supercal reserves the right to suspend or terminate your account if you violate these Terms. You will receive a notification at least one week prior to any such action.

11. Changes to the Terms

We may modify these Terms at any time. Users will receive an email notification at least one month before any changes take effect. New Terms will apply immediately; if you do not agree with the new terms, you may terminate your account.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms will be resolved in accordance with the dispute resolution process outlined below.

13. Dispute Resolution

Any disputes arising out of or related to these Terms or the use of Supercal will be resolved through mediation. If mediation fails, the dispute will be resolved through arbitration in accordance with the rules of the French Arbitration Association. The place of arbitration will be Paris, France.

14. Service Availability and Maintenance

While we aim to provide continuous access to Supercal, we may need to perform maintenance or updates. We will notify users of any scheduled downtime or maintenance at least 48 hours in advance.

15. Third-Party Services

Supercal may contain links to third-party websites or services. We are not responsible for the content or practices of these third-party services. Your use of any third-party services is at your own risk.

16. User’s Responsibility for Compliance

You are responsible for complying with all applicable laws and regulations regarding your use of Supercal. This includes ensuring that your use of the service does not violate any local, state, national, or international laws.
